Calaveras Superior Court and the Bail Bond Process

Calaveras Superior Court is located at 400 Government Center Drive in San Andreas, behind the Animal Services Building. This is the only trial court in Calaveras County and handles all criminal cases, from misdemeanors to serious felonies, as well as civil, family law, and probate matters.

For criminal defendants, the most important early court date is the arraignment. This is where formal charges are read, the defendant enters a plea, and the judge sets or adjusts bail. For most misdemeanor arrests, bail is set immediately at the jail by the bail schedule. For more serious felony charges or cases with special circumstances, a judge will set bail at the arraignment hearing.

If a judge sets bail at arraignment, we can post bond immediately after the hearing ends. We are available 24 hours a day and can often have a defendant released the same day as the hearing. How Bail Works at Calaveras Superior Court

Arraignment

The first court appearance after arrest. Formal charges are read, the defendant enters a plea, and the judge sets or confirms bail. Must happen within 48 to 72 hours of arrest under California law.

Bail Hearing

If bail was set at booking and the defendant or their attorney wants to reduce it, a formal bail review hearing can be requested. If the judge reduces bail, we can post the new amount immediately.

Court Appearances

After release on bail, the defendant must appear at every scheduled court date at Calaveras Superior Court. Missing court results in a bench warrant and bail forfeiture. We remind clients of this at posting.

Preliminary Hearing

For felony cases, a preliminary hearing determines whether there is enough evidence to proceed to trial. The defendant must remain on bail and appear at all scheduled dates through this stage.

Trial

If the case proceeds to trial, the defendant must appear throughout. Bail remains in effect until final disposition of the case. We explain ongoing obligations clearly at the time of posting.

Bail Exoneration

When the case ends, whether by dismissal, acquittal, or sentencing, the bail bond is exonerated. The court notifies the bail agent and the bond obligation is released.

Calaveras Superior Court is located at 400 Government Center Drive in San Andreas, in the same government complex as the Calaveras County offices. The courthouse handles all criminal cases in the county, from misdemeanor traffic violations to serious felony jury trials. All cases originating from arrests in Calaveras County, whether by the Sheriff, the Angels Camp Police Department, or the California Highway Patrol, are heard at this courthouse.

For defendants released on bail, court appearances are mandatory. Missing any scheduled court date results in the judge issuing a bench warrant for the defendant's arrest and potentially forfeiting the bail bond. If the defendant is a co-signer on a bail bond, this means they become personally responsible for the full bail amount. We explain these obligations in detail at the time of posting.

For misdemeanor charges, arraignment can happen on the first available court day. For felony charges, it must happen within 48 to 72 hours of arrest excluding Sundays and holidays.

Calaveras Superior Court operates Monday through Friday from 8:00 AM to 4:00 PM, excluding court holidays. However, arraignments and other urgent proceedings may be scheduled outside normal hours in some cases. The court clerk can be reached at (209) 754-9800. An attorney can represent a defendant and appear on their behalf for certain hearings, which is one advantage of being released on bail and having time to retain counsel.

Our role ends at posting the bond and ensuring the defendant understands their court obligations. The legal defense of the charges is handled by the defendant attorney.
